These Terms & Conditions apply to all purchases made from Aussie Ebikes (“we”, “us”, “our”). By purchasing from us, you agree to the terms set out below.
1. Shipping & Delivery Timeframes
We aim to dispatch orders as quickly as possible. Any delivery timeframes stated on our website, advertisements, or communications (including “2–7 day delivery”) are estimates only and not guaranteed.
Delivery times may vary due to factors outside our control, including but not limited to:

Courier delays

Weather events
-
Peak demand periods

Supply chain disruptions

Incorrect or incomplete delivery details
Business days exclude weekends and public holidays.
A delivery delay does not automatically constitute a failure under Australian Consumer Law unless the delay is considered unreasonable.
2. Risk, Title & Lost Parcels
Ownership of goods passes to the customer once the order has been dispatched. This does not affect your rights under Australian Consumer Law.
If a parcel is lost in transit, we will assist by lodging an investigation with the courier. A replacement or refund will only be issued once the courier confirms the parcel as lost.
3. Damaged or Faulty Goods
If your item arrives damaged or develops a fault, you must contact us within 7 days of delivery and provide clear photographic or video evidence of:

The packaging (where relevant)
We will assess the issue and provide a remedy in accordance with Australian Consumer Law. Remedies may include repair, replacement, or refund, depending on whether the issue is classified as a minor or major failure.
Failure to notify us within a reasonable timeframe may affect our ability to assist.

5. Change of Mind Returns

6. Australian Consumer Law – Fault Classification
Under Australian Consumer Law:

Major failure: The customer may choose a refund or replacement.

Minor failure: We may choose to repair, replace, or refund the product.
7. Electric Bike Use & Legal Compliance Disclaimer
Our electric bikes are sold for general use only. We do not represent or guarantee that any electric bike sold by us is legal for use on public roads, footpaths, shared paths, or other public areas in Australia.
Electric bike laws vary between:

Local councils

Road authorities
It is the sole responsibility of the customer to ensure that the product complies with all applicable local laws and regulations, including but not limited to:

Motor power limits

Speed restrictions

Throttle use

Registration or licensing requirements

Helmet and safety equipment requirements
Customers must verify legality with their local road authority before using the product in public areas.
8. Off-Road and Private Property Use
Unless explicitly stated otherwise, our electric bikes are supplied for off-road use or use on private property only.
Any use of the product in public spaces is at the customer’s own risk.
9. No Liability for Fines or Enforcement Action
We accept no responsibility or liability for:

Fines or penalties

Defect notices
-
Vehicle seizure or impoundment

Insurance refusal or cancellation
-
Enforcement action by authorities
arising from the use of the product in breach of any law or regulation.
10. Personal Injury, Accident & Safety Disclaimer
To the maximum extent permitted by law, we are not liable for any injury, loss, damage, or death suffered by any person arising from:

Use or misuse of the electric bike

Accidents or collisions
-
Loss of control
-
Mechanical failure after delivery

Improper assembly or maintenance

Modifications
-
Failure to wear appropriate safety equipment
Electric bike use involves inherent risks. The customer assumes all risks associated with use of the product.
11. Third-Party & Property Damage
We are not responsible for injury to third parties or damage to property caused by the use of the electric bike.
12. No Roadworthiness or Insurance Representation
We do not represent or guarantee that any electric bike:

Is road-registered
-
Is insurable
-
Complies with Australian Design Rules (ADR)
-
Meets any specific state or federal e-bike classification
Insurance eligibility is determined solely by insurers.
13. Performance & Range Disclaimer
All stated speeds, ranges, and performance figures are estimates only and based on ideal test conditions. Actual performance may vary depending on rider weight, terrain, riding style, weather, battery condition, and maintenance.
Variations in performance do not constitute a fault under Australian Consumer Law.
14. Battery & Wear Components
Batteries, brake pads, tyres, chains, and other consumable components are subject to normal wear and tear and are not covered for replacement unless a manufacturing defect is proven.
Battery capacity will naturally degrade over time and usage. Reduced capacity due to normal use does not constitute a fault.
15. Modifications
Any modification to the product, including but not limited to:

Speed limiters
-
Motor output
-
Controllers
-
Batteries
-
Throttles
voids any warranty and releases us from liability to the extent permitted by law.
16. Limitation of Liability
To the extent permitted by law, our liability is limited to repairing or replacing the goods or supplying equivalent goods.
Nothing in these terms excludes, restricts, or modifies any consumer guarantees under Australian Consumer Law.
17. Refund Processing
Approved refunds will be processed to the original payment method within a reasonable timeframe once returned goods are received and inspected.
18. Chargebacks & Disputes
Customers are encouraged to contact us first to resolve any issues. Lodging a chargeback without attempting to resolve the issue may delay resolution.
Fraudulent claims may be disputed with supporting evidence.
